Recent Nursing Home Abuse and Neglect Verdicts and Settlments in Pennsylvania:

 

A Delaware County jury awarded $19 million to the estate of 70-year-old Patricia O'Donnell who died allegedly due to improper care at the Brinton Manor Nursing and Rehabilitation Center. The verdict included $4 million in compensatory damages and $15 million in punitive damages against four defendants - two facility operators and two management companies.[1]

 

However, in January 2024, a judge reduced this verdict significantly based on the Scampone case law. The judge granted judgment notwithstanding the verdict to the two management companies, vacating their $8 million in punitive damages. The judge also reduced the punitive damages against one of the facility operators from $2 million to $385,000 since it only operated the facility for the final 21 days of the resident's stay.[2]

 

In 2022, the top 50 wrongful death settlements in Pennsylvania involving nursing home abuse and neglect ranged from $150,000 to $300,000. Several cases cited negligence, inadequate care, failure to supervise, and development of bedsores as grounds for the settlements.[3]
